The law behind
your water
and your land.

Your water rights and your land rights are what your farm is worth. Katika Consultants secures both nationally — for farmers, and for the town planners and property developers working on agricultural land — from water use licences and ELU registrations to SALA subdivisions, consolidations, rezoning and appeals. Same expertise, told straight, as The Legal Boeremeisie.

National Water Act 36 of 1998

s 21(a)

Eleven water uses. Four lawful pathways. One question: is yours authorised?

ALL NINE PROVINCES

PAARL · JOHANNESBURG · PIETERMARITZBURG

EN / AF — ALBEI TALE

EST. PRACTICE + PUBLIC PLATFORM

Pillar 1 · Water

Water rights, indexed to the Act itself.

NWA s 40–41

Water Use Licence Applications

Full WULA management from pre-application engagement to decision — including retrospective applications for uses already in operation.

NWA s 32–35

Existing Lawful Use

ELU registration, evidence assembly and defence — turning farm history into a recognised entitlement before validation and verification calls.

NWA s 27

Section 27 Motivations & Redress

The motivation is the application — and redress now carries real weight. DWS must consider the redress of past racial and gender discrimination, and transformation and B-BBEE credentials increasingly decide who gets water. We build the redress case that carries an application, before a weak one sinks it.

NWA s 39 · GN Gazettes

General Authorisations

Catchment-specific GA assessments and registrations — establishing when you can register instead of licence, and proving it.

NWA s 19 · s 53

Compliance & Directives

Pollution prevention duties, responses to directives and notices, and remediation planning when the Department comes knocking.

NEMA · ESTA · Agri-law

Environmental & Agricultural Law

Environmental authorisations, farm labour and occupier matters, and the regulatory questions that arrive with every farm transaction.

NWA s 56–60 · WARMS

DWS Billing Issues

Double invoicing, charges for water you don't use, or accounts on the wrong title deed — we reconcile your WARMS registrations with your DWS invoices and get the billing corrected.

Water and land don't move separately. A subdivision affects your water entitlement, and a rezoning can trigger new water use requirements. We look at both.

Pillar 2 · Land

Land rights, from Pretoria to your municipality.

Nationally, across all nine provinces. SALA consents go to the national Department of Agriculture in Pretoria, and land-use applications go to the municipality. We handle both sides and follow up with each — whether we act for the landowner directly or alongside the town planner and developer on a project.

Landowners & farmers

Subdividing, selling a portion, consolidating or putting land to a new use — we run the whole process for you.

Town planners

We handle the SALA consent and the Department of Agriculture side while you run the land-use application.

Property developers

Agricultural land sign-off and water entitlements sorted early, so they don't hold up your project later.

SALA · Act 70 of 1970

Subdivisions

Consent applications to the national Department of Agriculture to divide farm land, sell off a portion, or register a long lease over part of the farm — prepared, lodged and followed up until decision.

SALA · Municipal

Consolidations

Merging portions into one workable farming unit, covering both the Department and the municipal approvals — and the water entitlements that travel with the land.

Land use · By-laws

Rezoning & Land Use

Applications for new uses on agricultural land — agri-tourism, processing, on-farm housing, residential and mixed-use development — with the agricultural motivation that gets them approved.

SALA · Land use

Appeals

Consent refused, or conditions you can't live with? We review the decision, identify the grounds, and lodge a properly motivated appeal against refused SALA consents and unfavourable land-use decisions.

The Preservation and Development of Agricultural Land Act 39 of 2024 will replace SALA once it commences. Applications and appeals already lodged under SALA continue under the old Act — so there's no reason to wait. Book a consultation and we'll map the pathway for your property or project.

Client testimonials

What do our clients have to say?

In 2023 I realised that my affairs with the DWS were in a chaotic state.

My farming business was spread over numerous title deeds and over the years this gave rise to double invoicing and very confusing water registration documents. I attempted to liaise with the DWS but to no avail – emails went unanswered and telephone calls were a waste of time.

I attended a presentation by Katli Ngwane, representing her company Katika, for our local farming association. It soon became clear that my water registrations were all unverified and not yet lawful. I appointed Katli to represent my company and get everything in order.

Within three months the water registrations had been updated and been declared lawful, ownership issues had been sorted and the chaotic invoicing was corrected.

Katli and her team clearly know who to talk to at DWS and are able to get results quickly. I can recommend her firm's services to anyone struggling with water registration issues, as unverified, unlawful registrations carry an enormous risk for commercial farmers.

Neil PatersonPiketberg Mountain Farms · Piket-Bo-Berg, Western Cape

Being an irrigation farm in KZN with avocados, cabbages and potatoes, we were always wanting to know what areas we were allowed to use. After many attempts to receive our water use certificates we were unsuccessful. Katli and her team received them within 3 days. Amazing! We had tried ever since we bought the farm.

Katli received our water volume and storage certificates. We were under-using our water licence and now have a bigger area.

Wow, Katli, thank you so much.

Andrew WetherillHighlynn Farming CC · Highflats, KwaZulu-Natal

Katli, thank you for helping us navigate the muddy waters of WULs and registrations. It's been an absolute pleasure to have you on our team.

Your experience, knowledge and understanding have made our task so much simpler. We look forward to further engagements in the future as we grow our business.

About

Water and land law, told straight — by someone who actually likes farmers.

Since 2018, Katika Consultants has been a natural-resource regulatory practice built on one stubborn belief: the people who feed the country shouldn't need a translator to stay on the right side of the law. We handle Water Use Licence Applications, existing lawful use registrations and National Water Act compliance, alongside subdivision consents under the Subdivision of Agricultural Land Act, consolidations, rezoning and appeals, for producers across fruit, wine, livestock, dairy and crops, and for the town planners and property developers who need agricultural land sign-off — nationally, in all nine provinces, from offices in Paarl, Johannesburg and Pietermaritzburg.

At the helm is Katlego Ngwane — the voice behind The Legal Boeremeisie, the bilingual brand that turns dense water, land and agricultural law into something a farmer can use before lunch. She holds an LLB and a Postgraduate Diploma in Business Management from Henley Business School, and pairs the legal firepower with a genuine love for agriculture and the people working the land.

What sets Katika apart isn't just knowing the Act — it's the willingness to sit in the mess of red tape and government bureaucracy on your behalf, and come out the other side with a submission that holds up. Whether you need the full service or just the frameworks to do it yourself, you get the same expertise, told straight.

Katika is the name South African producers trust to protect the water and land their livelihoods depend on, from the vineyards of the Cape to the grain fields of the Free State and beyond. Farmers know where to turn to keep their rights secure. Our team are the people who walk the land with clients, speak their language, and turn complicated law into clear answers so they can get on with their work.
